WHAT IS SECTION 144 ?

144 has been announced by the Collectors of the respective districts under the Criminal Code (CRPC) as per the requirement of the Central and State Governments..What is this 144?

Section 144 of the Criminal Code is a measure that dates back to the British era. It is also known as an injunction. A District Magistrate, a Sub-Divisional Magistrate or an Executive Magistrate appointed by the Government has the power to issue a prohibitory order under Section 144.

They declare injunctions mainly in uncontrolled situations such as riots, agitations and epidemics in situations where human life or property is likely to be damaged or caused damage.

Prohibition prohibits fundamental rights of assembly and assembly under Article 19 of the Constitution 144 in five or more declared areas

Assembling of such persons is prohibited. It makes possession and carrying of arms an offence. Internet services can also be restricted if desired.

Normally the duration of 144 is up to 2 months. But in emergency situations it can be extended to 6 months. They can be withdrawn if the circumstances become normal. Out of this, Indian Penal Code (IPC) 141 to 149 cases are taken. Those convicted under Section 144 are liable to imprisonment for a maximum term of 3 years and fine.
